Question : Registering real estate property with POA in Karnataka?
Is it possible to register real estate property in Karnataka in absence by giving Power of Attorney to someone else?

Any immovable property can be conveyed/transferredby the registration of the sale deed which cantake place by the registrar of properies/tehsildarof the district where such property is located inpresence of the seller & buyer who have signedsuch sale deed & which is duly witnessed bycompetent witnesses of the said property or inpresence of any authorized person who hasregistered power of attorney issued by either ofthem. The registrar or the tehsildar has powers toverify the contents of the sale deed, ask for theidentity proof of the seller, buyer & witnesses orthe person who is appearing as power of attorneyfor either the seller or buyer. The person who haspower of attorney to appear & get the propertyregistered should carry the original & registeredpower of attorney in his or her favor, faillingwhich the registrar/tehsildar can refuse toregister the said property. This is the generalrule applicable for registration of immovableproperties in India. As far getting any propertyregistered by any person who is neither a sellernor buyer nor carrying any registered power ofattorney issued in his or her favor by either theseller or the buyer will not be possible in anystate of India including Karnataka.
